This is a high profile Legal and Compliance counsel role which will serve as key support for Legal and Compliance activities in the Europe, Middle East and Africa as well as Latin America regions for Telix. This role will be responsible for supporting the Regional legal and compliance strategy and operations, as part of a high performing legal and compliance team in the Region working closely with global, cross-regional and local stakeholders and functions. This role will play a critical role in supporting the Region’s commercial success, whilst navigating an increasingly complex set of applicable laws, regulations, risks and best practices.

The role will report directly to the Assistant General Counsel – EMEA & LATAM and also serve as Regional Compliance Officer.

Key Accountabilities

* Effective Legal and Compliance Risk Management
o Under the supervision of the Assistant General Counsel – EMEA & LATAM, establish oneself as a trusted and go-to business partner for legal, contractual and compliance advice in the region for a number of key functions such as Commercial, Market Access, Medical and Regulatory Affairs, etc.
o Support the implementation of effective legal and compliance programs to the Region and help to enable Distribution Partners with a focus on strategic and operational contracts, anti-bribery, interactions with healthcare professionals, corporate law, advertising code and regulatory healthcare compliance, HCP transparency, employee or labour law, litigation and investigations, competition, etc.
o Promote a culture of early engagement to ensure that legal and compliance are integrated by design, minimizing the potential for unforeseen issues.
o Support operational excellence and continuous improvement for Regional legal and compliance function and related activities
o Provide guidance on risk and compliance matters related to the Company’s commercialization activities in the biotech and pharmaceuticals sectors, ensuring that no unforeseen compliance risks arise.
o Facilitate drafting, review and negotiation of Regional operational and commercial contracts in accordance with agreed metrics and timeframes, such as sales agreements, supply agreements, distribution, licensing, consulting, services, master services agreements, grants, donations, HCP contracts and other associated activities
o Create, train and maintain regional contract templates, including support for automation of the templates in the global contract management system
o Work with outside counsel, internal and external support teams as may be required
* Serving as Regional Compliance Officer
o Effectively support the EMEA/LATAM Assistant General Counsel and the Global Compliance Officer in the implementation of key compliance programs and initiatives throughout the region
o Effectively implement new compliance policies, ensuring they are fully operational within the designated timeframe
o Becoming a go-to business partner for enquiries in the area of healthcare compliance, interactions with healthcare professionals and other key aspects of Telix activities for the region
o Review HCP engagements, activities, promotional and non-promotional materials for compliance with applicable laws, regulations, codes and Telix policies within agreed deadlines
o Participate in internal and external compliance audits and due diligences, as may be required
o Respond to any compliance incidents in a timely manner, supporting and implementing mitigation and remediation actions
o Support Regional HCP Sunshine and transparency reporting activity by the deadlines to comply with applicable laws, regulations and codes
o Contribute to deliver effective Legal and Compliance trainings consistent with regional needs and global legal guidance, materials and tools
* Global Functional Project support
o Active participation in Global Legal and Compliance functional projects to ensure smooth implementation in the Region and to help the function continuously improve worldwide, including contract policy and systems, compliance policy development, training and implementation, transparency reporting, monitoring of healthcare compliance, privacy, competition and anti-trust compliance activities

Education and Experience

* Completed legal studies, LLM specialization preferred, recognized within the Region
* Admitted to practice law in-house in Europe, Switzerland or the United Kingdom and current practicing certificate where required by applicable jurisdiction for in-house practice.
* Legal right to work in the Region
* 7+ years overall attorney legal experience (either at law firm or in-house)
* 3+ years in-house experience within the healthcare, biotech, medical device or pharmaceutical industry
* Proven track record and ability to effectively lead a complex area of responsibility
* Excellent interpersonal, communication and influencing skills in English – French or other European language skills a plus
